LINCOLN MASTERS OF BUSINESS ADMINISTRATION (MBA) CHALLENGE

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

TIMING: The Lincoln Masters of Business Administration (MBA) Challenge (“Challenge” or “Promotion”) consists of two (2) phases: 1) The Registration Period, which will begin on 10/12/15 at 12:00 AM ET and end on 10/30/15 at 11:59 PM ET (“Registration Period”), and 2) Challenge Period, which will begin on 11/13/15 at 12:00 AM ET and ends on 11/30/15 at 11:59 PM ET (“Challenge Period”), subject to the Test Drive Challenge Period as defined below. Administrator’s computer is the official time keeping device for the Promotion.

SPONSOR: Ford Motor Company, 16800 Executive Drive, Dearborn, MI 48126.

ADMINISTRATOR: Exposure Marketing & Promotion, Inc., 1000 North Opdyke Rd, Auburn Hills, MI 48326.

ELIGIBILITY: The Promotion is open only to matriculated students at an accredited Masters of Business Administration (MBA) program at a university in the United States who have a valid driver's license as of date of entry and who are members of a Marketing Club which is officially recognized by the applicable university (“Entrants”). Entrants will participate in the Challenge as part of a “Team,” to be comprised of four (4), with members of Team being set by Captain at beginning of the Challenge Period; and, one (1) Team member must be designated as the “Captain” of the Team (Captain will be the sole representative of the Team in all dealings with Sponsor, Administrator and/or Intern Queen, Inc. with regard to the Challenge, and the decisions of the Captain will be fully binding upon all Team members). In addition, for the avoidance of doubt, all Team Members must be matriculated students in the MBA program at the same university and members of the same Marketing Club at the applicable university. Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and same household members of Ford Motor Company (“Sponsor”), Intern Queen, Inc., Team Detroit, Inc., Exposure Marketing & Promotion, Inc., and their respective parent companies, subsidiaries and affiliates and companies involved in the implementation and execution of the Promotion (collectively the "Promotion Entities") as well as members of the general public (i.e., all persons other than matriculated students at an accredited MBA program at a university in the United States who are members of an MBA marketing club which is officially recognized by the applicable university) are not eligible. Promotion is void in Puerto Rico and other US Commonwealths, Territories and jurisdictions (including overseas military installations) and where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, Captain (on behalf of him/herself and all Team members) fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator/Intern Queen, Inc., which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

TO REGISTER: To register for the Challenge, visit www.LincolnMBAChallenge.com (the “Website”) between 10/12/15 at 12:00 AM ET and 10/30/15 at 11:59 PM ET and follow the online instructions to complete and submit the entry/registration process, including but not limited to the submission of the resumes of all team members (“Entry”). ALL ENTRIES MUST BE SUBMITTED BY 11:59 PM ET on 10/30/15. Limit: One (1) Entry per marketing club (as defined above). In the event more than the stated number of Entries are received from any one marketing club, the first Entry processed will be considered the only valid Entry received. Sponsor is not liable for late or misdirected entries. Entrants are responsible for all charges imposed by their Internet service provider and/or wireless service provider (as applicable), including any applicable taxes on such services, in connection with submission of an Entry.

TO PARTICIPATE IN THE CHALLENGE: Participants, those individuals and teams who successfully registered for the Challenge, may earn points in the Challenge by completing the following Challenges:

  1. TEST DRIVE CHALLENGE: Between 11/13/15 and 11/22/15 (“Test Drive Challenge Period”), utilizing methodology and materials provided by Sponsor, which shall not include unsolicited text messages, phone calls or emails, encourage law school students and lawyers in your community to visit your local Ford/Lincoln dealership and test drive a Lincoln vehicle on the date specified and agreed to as your Team’s test-drive date. Twenty-five (25) points will be awarded to a Team who generates a minimum of ten (10) completed test-drives and 10 completed pre & post surveys at the designated Ford/Lincoln dealership hosting the Challenge with all required information - including valid proof of status as law school student (student ID) or lawyer (verification of bar number and state of license) and thereafter takes a test drive on that date. For the avoidance of doubt, the content of an eligible participant’s survey answers/responses will not be taken into account, but the survey must be completed. Points awarded for the test drive challenge will be either zero (0) or twenty-five (25).  No partial points will be awarded.
  2. MARKETING STRATEGY CHALLENGE: Teams must develop a creative integrated marketing strategy plan that will make Lincoln relevant to law school students and lawyers in their community and describe how the marketing strategy can be activated across various channels. The marketing strategy should address the following points and comply with requirements set forth in the Program Guide, incorporated by reference herein and made part of these Official Rules, to be distributed to each Team:
    • Market Research - Identify existing and potential customers among law school students/lawyers in your community. Examine the “needs”, trends, market changes, and current events.
    • Product Mix - Which products do you plan to push to this audience in order to achieve the maximum profit potential?
    • Out-perform Competitors - Determine what, if anything, makes Lincoln fundamentally different from the competition.
    • Best Marketing Activity - Identify marketing activity that will ensure the target market knows about Lincoln products/ offers.
    • Marketing Tactics - What other marketing activities will you engage to cater to this customer?
    • Tracking Results - How will you track these marketing tactics/best practices and determine their effectiveness?
    • Social EngagementHow will you utilize use social media in accordance with applicable law, to market to these customers?

Each Team must submit one (1) version of the marketing strategy plan via email to Lauren@internqueen.com (or by other means as dictated in the Program Guide) by 11/30/15 at 11:59 PM ET. Submission must be made in accordance with the technical and procedural requirements of the Promotion Website at www.lincolnMBAChallenge.com, which are incorporated herein by reference and made a part of these Official Rules. Partial submissions will not be accepted. Once submitted, a Team’s marketing strategy plan cannot be supplemented, amended or modified in any manner except with the express consent of Sponsor/Administrator/Intern Queen, Inc., which may be granted or withheld in their sole discretion and without liability of any kind.

Marketing strategy plans will be evaluated equally by Sponsor/Intern Queen, Inc. to award points based on:

  1. Smart Innovation (25 maximum points) - Must approach leads with new ideas and new thinking. Ideas must be informed by data and supported by marketing best practices;
  2. Brand Consistency (25 maximum points) - Strategy maintains and furthers the three (3) core pillars of Lincoln (Quality, Design & Personal Service); and
  3. Real World Application (25 maximum points) -  Ability for Lincoln to apply the proposal into its Marketing Infrastructure in short term (3 years or less)

Each marketing strategy play will receive a maximum possible score of 75 points, as set forth in more detail in the Program Guide.

GRANT OF RIGHTS IN CONTENT CREATED FOR CHALLENGE: Captain, on behalf of him/herself and all Team members, grants to Sponsor and its designees the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicenseable right and license to use, perform, exhibit, reproduce and/or otherwise exploit all content created by the Team in participating in the Challenge in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to Captain or any Team members. Captain, on behalf of him/herself and all Team members, also waives any “Moral Right of Authors” (Droit Moral) in all content created by the Team in participating in the Challenge; and understands and agrees that the Sponsor has wide access to ideas, stories, designs and other literary/artistic materials submitted to it from outside sources or being developed by its own employees and that such ideas/stories/designs/literary/artistic materials may be competitive with, similar to (or even identical to) content submitted by his/her Team and that Sponsor shall have no liability to Captain, Team members or any third party in conjunction therewith.

RESTRICTIONS ON CONTENT: DO NOT COPY THE WORKS OF OTHERS, IN WHOLE OR IN PART. In submitting content, Captain (on behalf of him/herself and all Team members) makes the following representations and warranties:

  • Content is solely the original work product of Team and that the publication/distribution of the content will not violate the rights of trademark, copyright, right of publicity, right of privacy or any other intellectual property or proprietary right of any third party, nor does it libel, slander or defame any third party;
  • Content is not inappropriate or unfit for publication (for example, this includes obscenity and hate speech);
  • Content does not promote or advocate violence, alcohol or drug use or any illegal activity;
  • Content does not promote or advocate any cause or concern unrelated to the Contest theme (for example, a political or religious viewpoint).

GRANT OF RIGHTS BY FORD MOTOR COMPANY TO TEAM: Sponsor grants to Team (Captain and all Team members) the limited, non-transferable right to use certain designated Ford and Lincoln trademarks, logos, images and photographs of Lincoln vehicles, copyrighted material and other intellectual property rights (collectively, “Lincoln IP”) for the sole purpose of participation in the Promotion. Such grant of rights will automatically expire at the end of the Promotion Period. Any other use of Lincoln IP thereafter will be considered an actionable violation of Sponsor’s rights.

DISCLOSURE OF MATERIAL CONNECTION: Captain, on behalf of him/herself and all Team members, represents and warrants that ALL content created by Team that is used to encourage law students/lawyers to visit a local Ford/Lincoln dealership and test drive a Lincoln vehicle will clearly and conspicuously disclose that a material connection exists between the Team and Lincoln/Ford – specifically, the Team was formed and is conducting its activities with the express goal of winning a prize offered by Ford Motor Company in a promotional contest. Further, Captain, on behalf of him/herself and all Team members, represents and warrants that (a) all comments made about Lincoln and Ford Motor Company and/or its products represent the true opinions of all Team members and (b) any factual statements made about Lincoln/Ford Motor Company and/or its products have been properly researched and substantiated and have been determined to be factually accurate, to the best of Captain's/Team members' knowledge and belief acting in a reasonable and informed manner.

APPROPRIATE CONDUCT: Team is cautioned to comply with all applicable laws, rules, regulations and university/college policies at all times. With regard to the Test Drive Challenge, Team must at all times act in a respectful, polite and courteous manner toward all persons, including classmates/peers/friends, law students, lawyers, Ford/Lincoln dealership personnel, Intern Queen, Inc. representatives and college/university administrators and staff. BY WAY OF EXAMPLE ONLY, THE FOLLOWING CONDUCT WILL RESULT IN AUTOMATIC DISQUALIFICATION AND PERHAPS LEGAL SANCTIONS: COERCING OR PRESSURING PERSONS TO TAKE A LINCOLN TEST DRIVE; SEEKING TO BRIBE OR INFLUENCE AN ELIGIBLE PARTICIPANT IN PROVIDING ANSWERS/RESPONSES TO THE PRE-TEST DRIVE AND/OR POST-TEST DRIVE SURVEYS; ANY ACTIVITIES THAT ARE IN VIOLATION OF UNIVERSITY POLICIES.

DETERMINATION & NOTIFICATION OF WINNING TEAM: To determine the Winning Teams, the total number of Points earned by a Team (maximum 25 points) in the Test Drive Challenge will be combined with the Team’s score (out of a possible maximum score of 75 points) in the Marketing Strategy Challenge. The Teams with the three (3) highest total scores tabulated as set forth above by Administrator/Intern Queen, Inc., will be declared the winning teams. Administrator’s/Intern Queen, Inc.’s determination of the winning teams is final. In the event of a tie, Administrator/InternQueen, Inc., in conjunction with Sponsor, will determine the winning Team(s) based on which team(s) for the Test Drive Challenge had a higher number of eligible participants who completed the post-test-drive survey. In the event of a second tie, Administrator/InternQueen, Inc., in conjunction with Sponsor, will determine the winning Team(s) based on which team(s) for the for the Marketing Strategy Challenge had the highest score for the Smart Innovation portion of the Challenge. Captains will be contacted by Administrator via email, phone or mail (exact method(s) of notification to be determined by Administrator in its sole discretion.) As a condition of prize receipt/award, Captain (on behalf of him/herself and all Team members, as applicable) will be required to sign, complete and return Affidavit of Eligibility and Liability Release and except where prohibited by law, a Publicity Release Form (“Affidavit/Release”), as well a confirmation of the previous grant of rights (“Grant of Rights”) in content submitted by the Team in participating in the Promotion, within indicated time period. Captain further agrees without compensation to use his/her best efforts to secure an Affidavit/Release and/or Grant of Rights from all Team members, which must be returned by each Team member to Administrator within indicated time period. If the Captain of a winning Team fails to timely execute and return the Affidavit/Release and/or Grant of Rights, if Team is deemed ineligible to receive a prize, or if Captain cannot be contacted after reasonable effort as determined by Administrator in its sole discretion, prize will be forfeited and may, in Sponsor's/Administrator's sole discretion, be awarded to an alternate winning Team pursuant to the criteria set forth above. In all cases, prize will be awarded to the Winning Team’s Marketing Club, NOT to the Captain or any Team Member personally. Captain will accept the prize ON BEHALF OF THE WINNING TEAM’S MARKETING CLUB.

PRIZE: The following prizes will be awarded to the winning Team’s Marketing Club, with the check being made payable to the MBA Marketing Club:

  • First Prize                $10,000
  • Second Prize          $4,000
  • Third Prize               $2,000

Award of prize is subject to university policies regarding student clubs’ receipt of funding/incentives/prizing from third party entities. If applicable university policy prevents Sponsor from awarding prize monies to the Winning Team’s Marketing Club, such affected Winning Team will still be considered a Winning Team in the Challenge but Sponsor will have no financial commitment to such Winning Team’s Marketing Club; i.e., Winning Team’s prize will consist only of recognition as the Winning Team, and Sponsor, Administrator and Intern Queen, Inc. will have no further liability in conjunction therewith. All expenses and costs related to acceptance and use of prize are entirely the winning Marketing Club’s sole responsibility. Prize may not be transferred or assigned in whole or in part. No prize substitution is permitted. Winning Marketing Club’s receipt of prize may be reported to the Internal Revenue Service in accordance with applicable tax laws; and, Captain and Winning Team Member(s), as applicable, agree to fully cooperate with Sponsor/Administrator in conjunction with its fulfillment of such reporting requirements to the extent applicable.

GENERAL CONDITIONS / RELEASE: By participating, Captain (on behalf of him/herself and all Team members) (a) releases Promotion Entities, their respective directors, officers, agents and employees (collectively the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize. Neither Released Parties nor any service providers are responsible for any incorrect or inaccurate information supplied by Captains/Teams while participating in the Promotion, incorrect or inaccurate transcription of Entry information, or for any human or other error, lost data, omission, interruption, deletion, defect, any other error or malfunction, or late, lost, damaged, misdirected submissions. The preceding includes but is not limited to Test Drive Challenge data which is not captured due to technological error, malfunction or failure of any kind. CAUTION: ANY ATTEMPT TO DELIBERATELY TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Use of any automated system to participate is prohibited and will result in disqualification. Submitted content that is incomplete or corrupted is void. Sponsor and Administrator are not liable or responsible for late, invalid or misdirected content that is submitted, all of which will be disqualified. FOR THE AVOIDANCE OF DOUBT, CAPTAIN/TEAM (NOT THE RELEASED PARTIES) IS SOLELY RESPONSIBLE FOR SUBMITTING CONTENT IN CONJUNCTION WITH PARTICIPATION IN THE PROMOTION (I.E., MARKETING STRATEGY PLAN). Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Promotion is not capable of being executed as planned, tampering, unauthorized intervention, fraud, technical failures or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator reserves the right at its sole discretion to void content submitted by Team(s) and/or disregard surveys/test drives completed by eligible participants in tabulating points for Team(s) in the Test Drive Challenge, and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, Captains of all Teams will be notified thereof and the selection of the winning Teams will be made in a manner determined by Sponsor/ Administrator/Intern Queen Inc., in their sole discretion, to be fair, appropriate and consistent with these Official Rules.

GOVERNING LAW/JURISDICTION/DISPUTES: Captain, on behalf of him/herself and all Team members, agrees that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or the award of prizes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will Captain/Team members be permitted to obtain awards for, and Captain/Team members hereby waive all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Captain's/Team members' rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan.

PARTICIPANT'S PERSONAL INFORMATION: Personal Information collected from Participants is subject to Ford Motor Company’s Privacy Statement located on LincolnMBAChallenge.com.  By participating in the Challenge, you expressly agree to the terms of the Privacy Statement.

WINNERS: Names of winning Teams will be posted on LincolnMBAChallenge.com after the end of the Promotion.
